By now you probably have seen the news that Judge Marshall ruled in our favor. Basically he said the federal agencies erred in not doing what they should have. Until a proper Environment Assessment is done, with participation of the public including the Park Service, they can't guarantee the loans - they have one year to do so.
It is up to the banks who made the loans as to what they do.
The banks could make C&H find an alternate guarantor, or even force default on the loan, although I doubt that. Possibly the farm bureau or Cargill, or the pork producers organization or some such could step in and act as the guarantor. I assume that as long as C&H make timely payments, nothing will change operationally.
The EA will allow for public hearings, and could order changes in the operation to ensure safe operation. One comes to mind and that is that they MAY have to install a sewage treatment facility on site, or remove wastes from the site, both of which are very expensive options
By "winning" Earthjustice will be able to recoup all their costs with respect to the litigation.
