Moreover the old "we still must work within the law" is sometimes just a little bit too comfortable for me especially as I believe in the free expression of all rights I deem to be unalienable and natural rights -- "No man can really change his sentiments, judgments, and inward affections, at the pleasure of another; nor can it tend to any good to make him profess what is contrary to his heart. The right of private judgment is therefore unalienable" -- and I'm too far along in life to change at this late date. I am also willing to bear the consequences of my actions when so confronted by the autorities who enforce social contracts made by others.

Prophet -- come visit anytime -- as you know I'm a firm believer in the right of free passage and have never painted a tree purple or posted a sign that would hinder free passage. The gate and fence are there solely to minimize vandalism and reduce road traffic but as long as you're on foot and "take nothing but photos, leave nothing but footprints" you'll not hear a complaint from me -- just wipe your feet off on the red carpet.

Greatest harm? Farming!!

Per Tris's comments about eminent domain being used by private companies, this might be a link that should be of interest to those who are concerned:

There is a bill in the legislature that would address the problem. Might want to call somebody and let them know where you stand.

I have to commend Arkansas Times -- they are the only paper that routinely offers us insight into the "other side of the coin" -- otherwise all the dirt would be swept under the carpet.

I have to say that I am honestly torn over HB1178. One one hand it doesn't seem right for them to put a gathering line across someone's property who doesn't want it there but environmentally that can be very bad if they have to destroy a lot of extra ground in order to go around that property.

Good idea. And can we all vote on this while eating our chicken dinners (with a side of corn and potatoes of course) that were fried in the skillet we bought at Wal Mart over a natural gas stove under the incandescent lights in the kitchen of our wood-frame, cedar-shingled home?

In the end, perhaps we have met the enemy and they is us?

good point. Oil & Gas leases almost always provide the right to lay a pipeline for the company owning the lease. With a 3rd party (in name anyway) building the gathering lines, the right of way issue gets clouded. I'm not sure if thats a good bill or not either but thousands of wells have been drilled and pipelines laid across western Arkansas without using eminent domain proceedings. i should also clarify that pipelines don't destroy the ground, they're "wildlife openings" :idea:

Little update:

The sample I got was from a water-based "mud" spill that was caustic. ADEQ and AGF were notified. Apparently ADEQ did not impose any fine. That needs to change if companies are going to have any kind of incentive for playing by the rules.

A second spill in the same area was bulldozed, and ADEQ apparently was not notified (and therefore did nothing).
